Terms of Service

Welcome to VSTA Tomorrow (a 501(c)(3) nonprofit organization, referred to as “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website https://vstatomorrow.com (the “Site”), our membership services, email and SMS communications, and any related content or features (collectively, the “Services”). By accessing the Site, signing up for membership, or using any Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

These Terms form a legally binding agreement between you and VSTA Tomorrow. We may update these Terms at any time—see Section 11 for details. As a nonprofit, our mission is to foster community engagement through education, events, and updates; these Terms support that goal while ensuring fair use.

1. Eligibility and Account Registration

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By registering for membership, you represent that you meet this requirement and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us immediately at [email protected] of any unauthorized use.

We reserve the right to suspend or terminate accounts for violations of these Terms.

2. Membership and Services Description

Membership is free and provides access to exclusive content, event notifications, community forums (if available), and resources aligned with our nonprofit mission. Services include:

• Personalized dashboards for member profiles and preferences.
• Email newsletters and updates.
• Optional SMS alerts for time-sensitive events or alerts (see Section 3).
• Secure donation processing for supporting our initiatives.

All Services are provided “as is” without warranties—see Section 8. Membership is non-transferable and personal to you.

3. SMS Communications

As part of our Services, members may opt in to receive recurring automated text messages (“SMS Alerts”) for exclusive updates, event reminders, and notifications. This feature enhances engagement but is entirely optional and not required for membership.

Opt-In Process

• During signup or in your account settings, you must explicitly consent via a checkbox: “✓ I consent to receive recurring automated text messages from VSTA Tomorrow with exclusive membership alerts, updates, and event notifications. By checking this box and providing my mobile number, I explicitly consent to these messages (message and data rates may apply). Message frequency varies (up to 4 per month). Reply STOP to opt out anytime. Reply HELP for help. 
• Terms: vstatomorrow.com/terms | Privacy: vstatomorrow.com/privacy. Consent is not required for membership. Carrier support varies; not all devices supported. Standard rates apply.”
• Provide a valid U.S. mobile number in the designated field.
• Upon opt-in, you receive a one-time welcome SMS: “Welcome to VSTA Tomorrow! You’re now a member and opted in for exclusive text alerts. Reply STOP to end.”

Use and Frequency

• SMS Alerts are low-volume (up to 4 per month) and 2-way, allowing replies for confirmations or questions.
• Examples: “Join our Oct 25 webinar—RSVP: bit.ly/VSTA25 Reply STOP to opt out.”
• All messages include our brand, purpose, and opt-out instructions.

Opt-Out and Changes

• Reply “STOP” to unsubscribe anytime— we will confirm and cease sends within 10 minutes.
• Reply “HELP” for assistance or resend terms.
• Revoke consent via account settings or by emailing [email protected].
• We do not charge for messages; standard carrier rates apply. Unsubscribed numbers are added to our do-not-contact list.

We comply with the Telephone Consumer Protection Act (TCPA) and maintain opt-in records. International numbers may not be supported.

4. Payments and Donations

Donations and any paid features (e.g., premium event access) are processed securely via third-party providers like Stripe. All transactions are final:

• No Refunds: As our Services are intangible and digital (e.g., memberships, alerts, virtual events), all payments are non-refundable. This includes donations, which support our nonprofit operations and cannot be reversed once processed.
• Recurring donations can be canceled via your account or payment provider.
• We do not store full payment details—see our Privacy Policy for more.

Disputes should be directed to your payment provider first.

5. User Conduct and Content

You agree not to:

• Use the Services for illegal purposes or to harass others.
• Post harmful, defamatory, or infringing content (if user-generated features exist).
• Reverse-engineer, scrape, or disrupt the Site.
• Impersonate others or violate intellectual property rights.

We may remove violating content and report to authorities. You retain ownership of your user content but grant us a non-exclusive, royalty-free license to display it in connection with the Services.

6. Intellectual Property

All Site content, logos, and materials are owned by VSTA Tomorrow or our licensors. You may not copy, distribute, or commercialize them without written permission. Fair use for personal, non-commercial purposes is permitted.

7. Third-Party Links and Services

The Site may link to external sites or integrate third-party tools (e.g., Telnyx for SMS, Mailchimp for email). We are not responsible for their content, privacy practices, or availability. Review their terms before use.

8. Disclaimers and Limitation of Liability

The Services are provided “as is” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. We do not guarantee uninterrupted access or error-free operation.

To the fullest extent permitted by law, VSTA Tomorrow, its directors, officers, and volunteers shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility. Our total liability shall not exceed $100.

9. Termination

We may terminate or suspend your access at any time for violations, with or without notice. Upon termination, your membership ends, and you must cease using the Services. Sections surviving termination include 3 (SMS), 4 (Payments), 6 (IP), 8 (Disclaimers), and 10 (Governing Law).

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts in Austin, Texas. You waive jury trials and class actions.

11. Changes to These Terms

We may revise these Terms to reflect updates in our Services or laws. Changes will be posted here with a new “Last Updated” date. Significant updates will be emailed to members. Continued use after changes constitutes acceptance.
